The term of patent is for 20 years from the date of filing in India and it may be renewed. In case of non renewal patent may be revoked. Application for restoration of a patent that lapses due to non payment of renewal fees must be made within one year of lapse. Renewal fees are payable every year.

The first renewal fee is payable for third year of the patent life, and must be paid before the patent second anniversary. If the patent has not been issued within that period, renewal fees may be accumulated and paid immediately after the patent is sealed. No renewal fees are payable during the pend ency of the application for a patent; renewal fees that become overdue during dependency are payable upon sealing within three months of records in the Patent Register.
